Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and QuoteAmerica ("we," "us," "our") governing your access to and use of quoteamerica.org (the "Site"). By using the Site or submitting any form, you accept these Terms. If you do not agree, do not use the Site.

1. What the Site is

The Site is a free advertising and consumer referral service. We are not an insurance company, agency or broker; not a lender, mortgage broker or loan originator; not a contractor; and not a debt settlement company, credit counseling agency or law firm. We do not provide insurance, credit, financial, legal, tax or construction services, and we do not give advice of any kind. We connect consumers with independent third-party providers who do.

2. Eligibility

You must be at least 18 years old, a resident of the United States, and legally capable of forming a binding contract. You must be the owner of, or an authorized user of, the telephone number and email address you submit.

3. Your submissions

You agree that all information you provide is true, accurate, current and complete, and that you will not submit information about another person without their authorization. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and transmit the information you submit for the purposes described in our Privacy Policy.

By submitting a form with the consent box checked, you agree to the Consent to Contact disclosure, which is incorporated into these Terms by reference.

4. Third-party providers

Providers to whom we refer you are independent third parties. They are not our agents, employees, partners or joint venturers, and we do not control them. We make no representation or warranty regarding any provider's licensing, insurance, qualifications, workmanship, pricing, solvency, or the products or services they offer. Any transaction, contract, policy or agreement you enter into is solely between you and that provider. We are not a party to it and bear no responsibility or liability arising from it.

5. Prohibited conduct

You may not: submit false, fraudulent or another person's information; use any automated means to access the Site, including scrapers, bots or harvesters; attempt to gain unauthorized access to any system; interfere with or disrupt the Site; circumvent any rate limit or security measure; reverse engineer any part of the Site; use the Site for any unlawful purpose; or resell or commercially exploit any part of the Site or its content.

6. Intellectual property

The Site, its content, design, logos and the QuoteAmerica name and marks are owned by us or our licensors and are protected by copyright, trademark and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for your personal, non-commercial use. All other rights are reserved.

7. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure or error-free, that defects will be corrected, or that any content is accurate, complete or current.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER QUOTEAMERICA NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY DEALINGS WITH A THIRD-PARTY PROVIDER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (US $100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify, defend and hold harmless QuoteAmerica and its officers, directors, employees, agents and affiliates from any claim, demand, loss, liability, damage, cost or expense (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, your violation of these Terms, or your violation of any right of a third party.

10. Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content, policies or practices. Links are not endorsements.

11. Governing law and dispute resolution

These Terms are governed by the laws of the state in which QuoteAmerica maintains its principal place of business, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts of the jurisdiction in which QuoteAmerica maintains its principal place of business, and you consent to personal jurisdiction and venue there.

Class action waiver. To the fullest extent permitted by law, you and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

12. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 4 through 12 survive termination.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and the disclosures linked in the footer, are the entire agreement between you and us regarding the Site. Our failure to enforce any right is not a waiver.

14. Changes

We may modify these Terms at any time. Changes are effective when posted. Your continued use of the Site constitutes acceptance.
